1. Services

Globe Geeks provides digital marketing and AI automation services - including AI receptionists, chatbots, call intelligence, lead automation, SEO, paid advertising management and e-commerce growth services - as described on this website. Specific deliverables, timelines and fees for each engagement are defined in an individual proposal, order form or service agreement, which together with these terms forms the contract between us.

2. Engagement, billing and cancellation

Unless otherwise agreed in writing: plans are billed monthly in advance; engagements are month-to-month; either party may terminate with 30 days written notice (email suffices); and fees already paid for the current period are non-refundable once work for that period has commenced. Third-party costs - advertising spend, phone numbers, premium software - are paid by the client directly to the vendor or passed through at cost, and are the client's responsibility.

3. Client responsibilities

You agree to provide timely access to accounts and information reasonably needed to deliver services, to hold the legal rights to the business, content and data you give us, and to use our deliverables lawfully. For services involving call recording, SMS/WhatsApp messaging or email outreach, you are responsible for obtaining any consents required in your jurisdiction; we configure systems to support compliance but do not provide legal advice.

4. Ownership

Clients own their ad accounts, websites, domains, content, customer data and phone numbers provisioned for their campaigns. On termination we transfer any assets we administer on your behalf. We retain ownership of our pre-existing tools, frameworks, know-how and internal processes; you receive a perpetual license to use deliverables we create for you in your business.

5. No guarantees of outcome

Marketing and AI outcomes depend on factors beyond any agency's control - competition, budgets, market conditions, platform policy changes and algorithm updates. We do not guarantee specific rankings, lead volumes, revenue figures or AI-assistant citations. We commit to professional execution, transparent reporting and honest communication.

6. Intellectual property of this website

All content on this website - text, design, graphics, code - belongs to Globe Geeks and may not be copied, scraped for competing commercial purposes, or republished without permission, except as permitted by law.

7. Acceptable use

You may not use our website or services to send spam in violation of applicable law, to attack or probe our systems, to submit false or automated form entries, or for any unlawful purpose. We may suspend service to protect our systems or comply with law.

8. Disclaimers and limitation of liability

The website and services are provided "as is" without warranties of any kind, express or implied, to the maximum extent permitted by law. To the maximum extent permitted by law, our aggregate liability arising out of or relating to any engagement is limited to the fees you paid us in the one (1) month preceding the event giving rise to the claim, and neither party is liable for indirect, incidental, special or consequential damages, or lost profits. Nothing in these terms limits liability that cannot lawfully be limited, including under consumer protection laws of Australia or New Zealand where they apply.

9. Indemnification

You agree to indemnify us against third-party claims arising from your content, your products or services, or your breach of these terms; we agree to indemnify you against third-party claims that our original deliverables infringe their intellectual property rights.

10. Governing law and disputes

These terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules. The parties will first attempt to resolve any dispute informally within 30 days of written notice; unresolved disputes are subject to the exclusive jurisdiction of the state and federal courts located in California, except where the mandatory consumer or business laws of your country of residence grant you non-waivable rights or venue.

11. Changes

We may update these terms; material changes will be reflected by the date above and, for active clients, notified by email. Continued use after changes constitutes acceptance.
